Terms of Service

These Terms of Service govern access to and use of LeadAtomic's website, waitlist, onboarding flows, authenticated workspaces, and related communications.

By accessing or using LeadAtomic, you agree to these Terms. If you use LeadAtomic on behalf of a business or other organization, you represent that you have authority to bind that organization.

LeadAtomic is intended for business use. You may use the service only if you can form a binding agreement and only for lawful commercial or professional purposes.

You may not use LeadAtomic if doing so would violate applicable law, third-party provider rules, or the internal policies of the organization you represent.

• You are responsible for all activity under your account and for maintaining the confidentiality of your credentials.
• You must provide accurate account and workspace information and keep it reasonably up to date.
• You must promptly notify LeadAtomic if you believe your account, mailbox connection, or credentials have been compromised.
• LeadAtomic may require email verification, password resets, re-authentication, or other account-security steps before allowing certain actions.

You may not use LeadAtomic to do any of the following:

• Break the law, violate privacy or data-protection obligations, or send messages that are unlawful, deceptive, abusive, or harassing.
• Use the service to send spam, evade provider restrictions, or ignore deliverability, consent, disclosure, or opt-out obligations that apply to your outreach.
• Upload, connect, or process data unless you have the rights and authority needed to do so.
• Attempt to gain unauthorized access, interfere with service operation, bypass limits, probe vulnerabilities, or disrupt other users.
• Reverse engineer, scrape, copy, frame, mirror, benchmark competitively, or use the service to build a competing product, model, or dataset, except where applicable law clearly forbids that restriction.

You retain your rights in the data you submit to LeadAtomic. You grant LeadAtomic a limited right to host, store, transmit, transform, analyze, and otherwise process that data as needed to operate, secure, support, and improve the service.

You are responsible for the legality, accuracy, and suitability of your customer data, contact data, and outreach content, including any mailbox or provider account you choose to connect.

You represent that you have all rights, permissions, and notices needed for LeadAtomic to process your data and act on your instructions.

LeadAtomic may generate or assist with profile suggestions, enrichment, scoring, drafts, classifications, or other workflow outputs. Those outputs are assistive, not guaranteed facts or advice.

You are responsible for reviewing outputs before you rely on them, act on them, or send communications based on them. LeadAtomic does not guarantee accuracy, completeness, deliverability, reply rates, pipeline outcomes, or commercial results.

LeadAtomic may depend on or integrate with third-party services, including mailbox providers, infrastructure, transactional email providers, and model or API providers.

Your use of those connected services may also be governed by their own terms and privacy practices. LeadAtomic is not responsible for third-party outages, policy changes, access revocations, or acts and omissions outside LeadAtomic's reasonable control.

LeadAtomic may be offered in waitlist, beta, pilot, limited-release, or prelaunch form. Features may change, be delayed, be removed, or be made generally available on different terms.

Unless LeadAtomic expressly agrees otherwise in writing, the service is provided without a service-level agreement, minimum availability commitment, or guarantee that any feature will continue unchanged.

If you purchase or subscribe to a paid LeadAtomic plan, you agree to pay the applicable fees, taxes, and charges presented at the time of purchase or otherwise agreed in writing.

Except where required by law or expressly stated otherwise, fees are non-refundable. LeadAtomic may update pricing prospectively. Continued use of a renewed or upgraded paid plan after a price change takes effect means you accept the new pricing.

LeadAtomic and its related software, content, design, branding, and product logic are owned by LeadAtomic or its licensors and are protected by applicable intellectual-property laws.

Subject to these Terms, LeadAtomic gives you a limited, revocable, non-exclusive, non-transferable right to use the service for your internal business purposes.

If you provide feedback, ideas, or suggestions, LeadAtomic may use them without restriction or obligation to you.

LeadAtomic may suspend, restrict, or terminate access immediately if we reasonably believe it is necessary for security, abuse prevention, legal compliance, provider restrictions, non-payment, or protection of the service or other users.

You may stop using the service at any time. Termination does not remove obligations that by their nature should survive, including payment obligations, confidentiality obligations, usage restrictions, disclaimers, liability limits, and indemnity obligations.

To the maximum extent permitted by law, LeadAtomic is provided "as is" and "as available." LeadAtomic disclaims all warranties, whether express, implied, statutory, or otherwise, including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, availability, accuracy, quiet enjoyment, and uninterrupted operation.

LeadAtomic does not warrant that the service will be error-free, secure against all threats, always available, or suitable for your specific compliance, marketing, or commercial needs.

To the maximum extent permitted by law, LeadAtomic will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, goodwill, data, business opportunity, or anticipated savings, even if LeadAtomic was advised that such damages were possible.

To the maximum extent permitted by law, LeadAtomic's total aggregate liability arising out of or relating to the service or these Terms will not exceed the total amount you paid LeadAtomic for the service during the 12 months before the event giving rise to the claim, or, if you paid nothing, US$100.

You will defend, indemnify, and hold harmless LeadAtomic and its affiliates, personnel, and service providers from claims, liabilities, damages, losses, and costs arising out of or related to your data, your use of the service, your connected mailboxes, your outreach activity, your violation of these Terms, or your violation of applicable law or third-party rights.

• LeadAtomic may send you operational notices electronically, including through the service or by email.
• You may not assign these Terms without LeadAtomic's prior written consent. LeadAtomic may assign these Terms in connection with a merger, financing, restructuring, or asset sale.
• If any provision of these Terms is held unenforceable, the remaining provisions will remain in effect.
• A failure to enforce any provision is not a waiver of that provision or any other provision.
